1. General points & validity of the General Terms and Conditions
1.1 The general terms and conditions (hereinafter referred to as GTC) regulate the comprehensive terms and conditions and services between SCHMIED JUNIOR COSMETICS GmbH (hereinafter referred to as SCHMIEDJUNIOR-COSMETICS.CH) and its customers.
1.2. Deviations from these terms and conditions are only effective if we confirm them in writing.

2.1. The offers on the SCHMIEDJUNIOR-COSMETICS.CH web shop are subject to change and are not to be understood as binding offers. An order only comes about through the order confirmation via e-mail or through the delivery of the ordered goods. The availability of the items by our suppliers or manufacturers remains reserved.
2.2. The information in our sales documents (drawings, illustrations, dimensions, weights and other services) are only to be understood as guide values and do not represent any guarantee of properties unless they are expressly designated as binding in writing.

3. Prices
3.1. All SCHMIEDJUNIOR-COSMETICS.CH prices are shown in CHF and are subject to change. The prices include value added tax (VAT).
3.2. Technical changes, errors and misprints are reserved.
3.3. SCHMIEDJUNIOR-COSMETICS.CH can make price changes at any time and without prior notice.
4. Shipping Costs
4.1. Unless explicitly stated otherwise in the order, we deliver all products that are ordered via the SCHMIEDJUNIOR-COSMETICS.CH web shop without a special note, free of charge within Switzerland and the Principality of Liechtenstein.
4.2. Delivery to other countries is not possible.
5. Payment
5.1. The delivery takes place only against payment in advance. Payment on account is not possible.
5.2. SCHMIEDJUNIOR-COSMETICS.CH accepts prepayment, credit cards, EC-Direkt, TWINT as payment methods. When paying by credit card, the commission rate published on the website applies.
5.3. Without special agreements, a payment period of 10 days after placing the order applies.
6. Late Payment
6.1. If the customer fails to settle his debts after the set period of grace, SCHMIEDJUNIOR-COSMETICS.CH can claim damages and proceed according to the provisions of the Swiss Code of Obligations (OR). In particular, SCHMIEDJUNIORCOSMETICS.CH has the right to assign outstanding debts to external debt collection companies.
7. Delivery
7.1. The delivery takes place exclusively via shipping. A pick-up is not possible for logistical reasons.
7.2. The specified delivery times are only to be understood as guide values. These are not binding. If a delivery deadline cannot be met, the customer can withdraw from the order placed after a grace period of at least 14 days, which he must notify in writing. The customer cannot assert any further claims.
7.3. Confirmed orders can be canceled by SCHMIEDJUNIOR-COSMETICS.CH without incurring any costs due to external circumstances that cannot be influenced.
7.4. The transport risk is transferred to the buyer as soon as the shipment has been handed over to the transport company. However, the shipment has limited insurance. Damage to the delivered goods must be reported to the transport company as soon as possible, but no later than 4 calendar days after delivery. In the event of complaints, all parts of the original packaging must be kept. These may only be disposed of with the written consent of the transport company or SCHMIEDJUNIOR-COSMETICS.CH.
7.5. Delivery is always to the shop.

8. Warranty
8.1. Unless otherwise expressly agreed in writing, the warranty is 12 months in accordance with the following provisions.
8.2. The warranty begins with the delivery date. If the defect is due to improper use, storage or handling, the warranty is void. Insignificant deviations from the guaranteed properties of the goods do not trigger any warranty rights.
8.3. Warranty claims against SCHMIEDJUNIOR-COSMETICS.CH are only available to the direct buyer and cannot be assigned to third parties.
8.4. The buyer is exclusively entitled to rectification or exchange (replacement delivery). Conversion and reduction of the amount are excluded. SCHMIEDJUNIOR-COSMETICS.CH decides whether to repair or replace an item.

9. Exchanges and Returns
9.1. In principle, there is no general right of return. However, we offer you a 100-day exchange policy. Items can be returned within 100 days of receipt of delivery and money will be refunded to you in the form of a merchandise voucher. However, the return must be agreed with us in advance and the return requires the written consent of SCHMIEDJUNIOR-COSMETICS.CH.
9.2. The goods must be complete, undamaged, unused and in their original packaging. Used, assembled goods or goods that are not in their original packaging are excluded from the right of exchange.

10. Limitation of Liability
10.1. According to these terms and conditions and the remaining contractual provisions, SCHMIEDJUNIOR-COSMETICS.CH undertakes to provide the customer with due care.
10.2. Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved.
10.3. Liability for indirect damage and consequential damage resulting from use, faulty performance or loss of performance is excluded.

11. Privacy
11.1. SCHMIEDJUNIOR-COSMETICS.CH is entitled to process the data received about the buyer in relation to the business connections or in connection with these, regardless of whether they originate from the buyer himself or from third parties, in accordance with the Federal Data Protection Act.
11.2. Personal customer data is treated confidentially and not passed on to third parties.

12. Changes to Terms and Conditions
12.1. We reserve the right to change the terms and conditions at any time. The terms and conditions as published on our website apply. For purchase orders that were placed before the changed GTC came into effect, the previous GTC also apply after the changed GTC came into force.

13. Jurisdiction
13.1. The place of jurisdiction for all disputes with SCHMIEDJUNIOR-COSMETICS.CH is - subject to mandatory deviations - Bern - Mittelland. The legal relationship is subject to Swiss law.
